There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock on Wednesday, February 11, 2009, at 8:00 p.m. in the Council Chambers of the Municipal Building.

This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

RESOLUTION AUTHORIZING CHANGE ORDER #3 - CREDIT
MUNICIPAL BUILDING RENOVATION PROJECT
ADDITIONAL WORK ON TANK REMOVAL – CONCRETE FILLED

WHEREAS, the Mayor and Council of the Borough of Glen Rock approved change orders #1 and #2 for a total of $21,420.35, for the removal of a diesel fuel tank at the renovation site of the municipal building on November 12, 2008 and January 7, 2009; and

WHEREAS, as a result of the actual work performed during the removal of the diesel tank a cost credit was issued to the Borough of Glen Rock by the contractor, Walter H. Poppe, General Contractors; and

WHEREAS, Walter H. Poppe General Contractors has submitted Change Order #3 to reflect such cost credit.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Glen Rock that change order #3 be approved as a reduction of $3,455.77 for the additional costs of removal of the diesel fuel tank to. Walter H. Poppe General Contractors, subject to certification of funds by the CFO.

WHEREAS, it has been determined by the Tax Collector that the taxpayer Mohyi Refaie successfully appealed his added assessment tax bill with the County of Bergen on Block 135 Lot 9 and;

WHEREAS, Hudson City Savings Bank made the added assessment payment causing an overpayment of $5,106.92;

NOW, THEREFORE, BE IT RESOLVED that Borough of Glen hereby reimburses Hudson City Savings Bank for the tax overpayment in the amount of $5, 106.92.

ORDINANCE NO. 1594

AN ORDINANCE TO AMEND CHAPTER 216 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF GLEN ROCK - 1971 AS AMENDED ENTITLED "VEHICLES AND TRAFFIC” BEING AN ORDINANCE REGULATING THE PARKING AND OPERATION OF VEHICLES WITHIN THE BOROUGH; TO LIMIT PARKING ON CERTAIN STREETS WITHIN THE BOROUGH

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of
Bergen, State of New Jersey, as follows:

Section I - Chapter 216 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Vehicles and Traffic" is hereby amended as to the following section:

1. Section 216-38 entitled “ Schedule XI: “Traffic Control” is hereby amended by deleting the following:

Location Turn Prohibited

Rock Road All westbound vehicles on Rock Road shall be 
prohibited from making a left or a U-turn into any 
angle parking stall along the southerly curbline of Rock 
Road between West Plaza and Main Street

2. Section 216-38 entitled “Schedule XI - “Traffic Control” is hereby amended by adding thereto the following:

along the southerly curbline of Rock Road between West Plaza and Main Street may only be accessed by
eastbound traffic along Rock Road. 

Section II. VALIDITY-SEVERABILITY. If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

Section III All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed. 

Section IV This Ordinance shall take effect upon passage as required by law.

ORDINANCE NO. 1595

AN ORDINANCE TO AMEND CHAPTER 216 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF GLEN ROCK - 1971, AS AMENDED, ENTITLED "VEHICLES AND TRAFFIC “BEING AN ORDINANCE CONTROLLING VEHICLES AND TRAFFIC WITHIN THE BOROUGH OF GLEN ROCK: 
TO AMEND THE STANDARDS AND REGULATIONS RELATING THERETO; TO AMEND THE STANDARDS AND REGULATIONS RELATING THERETO DURING THE RECONSTRUCTION OF THE GLEN ROCK MIDDLE SCHOOL AND HIGH SCHOOL.


WHEREAS, the Board of Education of the Borough of Glen Rock will begin the reconstruction of its Middle School and High School which will result in the temporary loss of most of the on-site parking provided to its Administrative and Educational staff, Students and Visitors; and

WHEREAS, the Mayor and Council of the Borough of Glen Rock, in conjunction with the Board of Education, desires to stem the overflow of vehicular traffic into and upon the streets surrounding the Middle School and High School and to prevent the overcrowding of said streets with parked vehicles operated by the aforesaid Administrative and Educational staff, Students and Visitors to the Glen Rock Middle School and High School, as well as to those residents residing within the affected streets; and

WHEREAS, the Governing Body desires to put into effect a temporary parking plan to address the overflow of vehicular traffic into the and the resultant congestion in and upon the streets surrounding the Glen Rock Middle School and High School; and

WHEREAS, it is the express purpose of this ordinance to assist in the reducing of hazardous traffic conditions resulting from the temporary loss of on-site parking at the Glen Rock Middle School and High School which may cause the overflow of traffic onto and possible overcrowding of streets primarily serving residential land uses with parked vehicles emanating from the Middle School and High School, to protect the residents of such streets from the unreasonable burden in gaining access to theirs residents, to preserve and protect the safety of the children and other pedestrians and traffic safety on said streets and to generally promote, preserve and protect the peace, good order, safety and welfare surrounding the Glen Rock Middle School and High School School.

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

Section I - Chapter 216 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Vehicles and Traffic" is hereby amended as follows:

A. Section 216-35 entitled “Schedule I: Parking Prohibited at All Times” is hereby amended by deleting the following street designations:

5. MEETING OPEN TO THE PUBLIC: (Before speaking at the meeting, each person must state their name and address. 5 minute limit)

Sally Killeen – 333 Doremus Avenue – Mrs. Killeen asked if there have been any arrangements made to deal with the odor at the Recycling Center. Mayor van Keuren stated he believes the staff at the Recycling Center is attempting to remove the yard debris and in so doing the debris is disturbed, creating a strong odor. Unfortunately, the recent weather has delayed the removal of debris. Lenora Benjamin added that the time allotted to Glen Rock for use of the tub grinder has not been adequate, creating the leaves to sit longer than usual. 

Jim Seaton – Ferndale Avenue – Mr. Seaton stated that the road conditions are becoming deplorable. Mr. Seaton believes roads should be patched when potholes and cracks occur. 

At this time, Mayor van Keuren brought up the subject of sustainability. The concept of sustainability was first presented to the municipality at the League of Municipalities last November. It involves the municipality taking actions now in an effort to preserve and extend the natural resources of the town. From this concept a resolution was developed to formally define the value of sustainability and appoint people to a Sustainable Glen Rock Committee. 

The issues that are currently at hand are: 1) who should be on the committee; and 2) how much of an obligation the Council undertakes when it appoints a sustainable Glen Rock task force. Mayor van Keuren believes the Council should not be part of the developmental process but rather act as a body that supports the proposals, in a cost-conscience way. 

The Council is currently under extreme budget constraints to make the municipal budget as lean as possible, consequently cost-management is extremely important and an obligation of this Council. 

Mayor van Keuren stated that although the objectives noted in development of this resolution are valid and should be heard, the Council should not be part of the Task Force. Any recommendations should be brought to the Council for consideration. 

Mayor van Keuren stated he is not opposed to a sustainable Glen Rock. Mayor van Keuren encouraged Cindy Mehallow and Leslie Kameny to talk about what they believe the objective of the Task Force should be and what the Council’s role would be.

Cindy Mehallow – 373 Dunham Place – Mrs. Mehallow agrees that a structure without the Council as part of the Task Force works better than initially discussed. Mrs. Mehallow believes that a resolution from the Council signifies an intent and awareness that sustainability is important. The Council would then appoint a committee to determine what action should be done to accomplish Glen Rock becoming a sustainability community. 

Cindy continued stating that she has contacted East Windsor who has developed an extensive action plan which is full of various recommendations and suggestions to attain sustainability. A possible first step would be to conduct an energy audit, through the help of a generous State grant. The State would subsidize 75% of the cost of the audit with the remaining 25% refunded if the actions are implemented. 

The sustainability concept and resolution were discussed in further detail with plans to address at the February 25th meeting.

Bill Brown – 675 Lincoln Avenue – Mr. Brown thanked the Council for their awareness to cost efficiency and encouraged the Council (or Council appointed committee) to pursue any available grants.
