There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock on Wednesday, April 15, 2009, at 8:00 p.m. in the Council Chambers of the Municipal Building.

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

WHEREAS, there is pending before the Tax Court of New Jersey, the matter of Rock Glen Associates vs. Borough of Glen Rock; and

WHEREAS, the Borough’s Tax Assessor, Steven Rubenstein, has reviewed the property record card, comparable sales and has made a physical inspection of the property; and

WHEREAS, the Tax Assessor, has recommended a modification to the 2007 and 2008, assessment; and

WHEREAS, as a result of discussions between the Tax Assessor and the Plaintiff’s attorney, it is recommended to the Mayor and Council that settlement of this matter be ratified and approved.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council as follows: 

1. The Mayor and Council having reviewed the recommendation for reduction in the assessment of the following Tax Court of New Jersey appeal do hereby ratify the following settlement:

3. Resolution Extending Pool Concession Contract (Caputo’s)

RESOLUTION EXTENDING POOL CONCESSION BID 

WHEREAS, the Borough of Glen Rock received bids on April 29, 2008 for the municipal pool concession and the lowest bid came from M&V Enterprises, Inc. t/a Caputo’s Catering of Fair Lawn, New Jersey; and

WHEREAS, M&V Enterprises, Inc. t/a Caputo’s Catering has previously operated the snack bar for the past four seasons; and

WHEREAS, the contract allows the Borough the option to extend the contract for two years, and 

WHEREAS, the Borough would like to exercise their right to extend this contract for two additional years (2009 & 2010) with the price change being adjusted in accordance with the specifications of 10% more than the contract award price for each year; now therefore

BE IT RESOLVED, that the Borough Council of the Borough of Glen Rock, hereby awards an extension of the 2008 Pool Concession Contract for an additional two years to M&V Enterprises, Inc. t/a Caputo’s Catering for a payment to the Borough for an operating fee of $5,010 in 2008 and a 10% increase for 2009 of $501.00 ($5,511.00) and for 2010 an a 10% increase of $551.10 ($6,062.10).

WHEREAS, the Borough of Glen Rock currently maintains its own Public Assistance Program for the purpose of providing general public assistance to individuals of the Borough of Glen Rock pursuant to the provisions of N.J.S.A 44:8-108, et. seq., as well as other provisions of New Jersey State Law and Municipal ordinances; and

WHEREAS, New Jersey State law provides in N.J.S.A. 44:8-145.1 that a municipality may transfer the financial and operational responsibility for the administration of general public assistance to the County in which it is located; and

WHEREAS, the Governing Body has determined that upon the retirement of its Welfare Director, it would be in the best interest of the residents and taxpayers of the Borough of Glen Rock to request that the financial and operational responsibility for this department be transferred to Bergen County.

BE IT FURTHER RESOLVED by the Mayor and Council of the Borough of Glen Rock, County of Bergen and State of New Jersey as follows:

1. The Borough Attorney and Borough Administrator are hereby authorized and directed to take any and all action which may be required in order to facilitate the transfer of the financial and operational responsibility for the administration of general public assistance to the County of Bergen. 

2. The Borough Attorney is hereby authorized to review and /or prepare any documents, resolutions, ordinances or contracts which may be required in order to facilitate this transaction. 

3. The Borough Administrator shall report to the Governing Body as to the procedure which must be utilized for the transfer, as soon as that information is available for further action of the Governing body, if further action shall be required. 

BE IT FURTHER RESOLVED that the Borough Clerk be and is hereby authorized and directed to forward a certified copy of this resolution to the County of Bergen, and the Borough of Glen Rock Department of Public Welfare.

RESOLUTION SUPPORTING NO IDLE ZONE

WHEREAS, the Council and Mayor of Glen Rock has approved a resolution which creates a Sustainable Glen Rock Steering Committee whose mission is to pursue actions which will lead to a Sustainable New Jersey Municipal Certification for the borough of Glen Rock: and 

WHEREAS, a no idling policy is a key action for that certification; and

WHEREAS, emissions from gasoline and diesel-powered vehicles contribute significantly to air pollution, including greenhouse gases, ozone formation, fine particulates; and 

WHEREAS, numerous scientific studies and agencies have found links between exposure to fine particles and diesel exhaust to cause significant health effects including premature death, and increased incidents of asthma, allergies, and other breathing disorders; and 

WHEREAS, vehicle idling occurs in locations (e.g. school grounds, parking lots, distribution centers, strip malls, construction sites, business centers, etc.) where residents can be exposed to concentrated sources of air pollutant emissions; and 

WHEREAS, the reduction of fine-particle emissions from diesel engines could prevent breathing and other health related illnesses and millions in health care related savings can be realized; and 

WHEREAS, petroleum-based gasoline and diesel fuel are nonrenewable fuels and should be used wisely and not wasted and idling more than 10 seconds uses more fuel and emits more pollutants than turning an engine of and on again; and

WHEREAS, current state law prohibits the idling of vehicles for more than three minutes and studies have shown that an anti-idling policy will not only save fuel, but also prolong engine life, and improve air quality which in turn provides a healthier and safer environment for Glen Rock residents. 

NOW THEREFORE BE Proclaimed that the Town Council of the borough of Glen Rock , County of Bergen, State of New Jersey supports the adoption of an anti-idling policy by government agencies, schools, businesses, and other organizations, and establishes GLEN ROCK as a "No Idle" Zone by the following: 

1. Ensure the enforcement of New Jersey’s existing no-idling law pursuant to C. 39:3-70.2 and C. 26:2C-1; 

2. Encourage all drivers to turn off any gasoline or diesel-powered motor vehicle engines immediately at schools and off-site school related events to minimize exposure of residents, and particularly children, to vehicle emissions; 

3. Maintain municipal vehicles to reduce and/or eliminate any visible exhaust and complying with the annual inspection requirement for those vehicles; 

5. Support broad education of the public about the health, environmental and economic impacts of idling and ways to reduce idling.

Section I - Chapter 101 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Fees" is hereby amended by adding thereto the following: 

A. Chapter 101 of the Revised General Ordinance of the Borough of Glen Rock, 1971 as amended, entitled “Fees” is hereby amended as follows:

1. Section 101.20 entitled “Commuter Shuttle Transportation” is amended by adding thereto a new subsection “C” to read as follows:

“C. The annual fee referenced in sections A and B above shall be waived for any resident having a valid Resident Commuter Parking Permit issued pursuant to the provisions of Borough Ordinance §101.14C, as amended and/or supplemented.
Section II. VALIDITY-SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.
Section III All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed. 
Section IV This Ordinance shall take effect upon passage as required by law.

5. MEETING OPEN TO THE PUBLIC: (Before speaking at the meeting, each person must state their name and address. 5 minute limit)

Jeanne Rey – Winslow Terrace – Mrs. Rey asked that respect be shown to Irene Brown with the passing of her husband, Bill.

Robert Sheridan – 90 Forest Road – Mr. Sheridan commented that the police cars often idle for considerable amounts of time (notice the Council passed a “No Idling” resolution this evening). Mr. Sheridan asked why the overpass on Maple Avenue wasn’t paved. Lenora Benjamin commented the overpass has also been paved. 

Jim Seaton – Ferndale Avenue – Mr. Seaton thanked the Council (O’Hagan) for the sign installation on Maple Avenue. 

Mark McCullough – 400 Prospect Street – Mr. McCullough commented that the State has created a law (graduated driver’s license – GDL) that can only be enforced by targeting (profiling) younger drivers. The State has managed to pass a law that they don’t have to enforce, but rather the local municipalities. Mr. McCullough cautioned the Council to determine how they feel about this (and a new one coming soon, which is even worse) and how it can be enforced without violating drivers’ rights. Mr. McCullough believes this law makes “driving while young” a crime. 

Robert Smith – 63 Lowell Road – Mr. Smith commented he has received a violation to remove a trampoline, which (mistakenly) is not in his front yard. Mr. Smith supplied numerous photos of similar properties with the same scenario. Mr. Smith stated he is offended by the violation, particularly since he has a corner property and pays high taxes for that property. Mr. Smith asked why he, and not other similar properties, is being asked to remove his trampoline. Mayor van Keuren commented this body is probably not the proper body to investigate this (Zoning Dept.); however he and/or the Borough Administrator will find out an answer. 

Bill Ashe – 162 McKinley Place – Mr. Ashe asked if the cell tower (at the Recycling Center) will be camouflaged. Mayor van Keuren stated there are no plans to camouflage this tower; however the tower on Prospect Street is a tree. Mr. Ashe asked if monitoring of emissions would be conducted. Mayor van Keuren stated the Borough is in the process of acquiring the necessary equipment to monitor the towers. Mr. Ashe questioned the radio equipment that is to be installed at the tower. Mayor van Keuren stated there is radio equipment there already; however the equipment Mr. Ashe is referring to would be for an additional carrier that has propositioned the Borough. Mr. Ashe asked why the Borough received less funding from the State and who “looks after” Glen Rock in this regard. Mayor van Keuren stated the Borough did receive less funding as a result of State cutbacks adding that our Congressman, Senators and Assemblymen who represent our district “look out” for Glen Rock. Mayor van Keuren noted that Glen Rock did better than many of the surrounding towns with regards to the amount of the reductions.

Betty Ashe – 162 McKinley Place – Mrs. Ashe commented that the cell tower is aesthetically unappealing. Mrs. Ashe added that the tower affects their property values and wondered if there is any way the tower could be painted or disguised. 

Dick Hahn – 1 Glen Avenue – Mr. Hahn asked for additional information on several of the resolutions.

Neil Finn – Doremus Avenue – Mr. Finn expressed condolences on the passing of Bill Brown. Mr. Finn commented on the recent resignations of Board of Education members and their replacements. Mr. Finn also commented on the recent Candidate’s Night and how only questions submitted in writing prior were read. There were no questions accepted from the audience and those that were submitted in writing were very benign. The meeting concluded very abruptly at 9:15 p.m. Mr. Finn commended the Council on the excellent job done by keeping the municipal portion of the budget to a minimal increase. 

Lenora announced she and Chief Cherry have monitored the high school parking arrangements and have concluded to reduce the amount of dedicated teacher parking on Radburn Road which will open up additional parking for students, which should alleviate parking on Emerson and Cornwall. 

Based on earlier conversations, Lenora commented that the pesticide used does have an EPA registration number and is classified as a general use pesticide. The Borough has used a licensed applicator and guidelines are being followed. Additional applications will be more organic. The process being used is the best for Glen Rock which will allow for the field to be regenerated and hopefully hold up longer into the season.
