There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock on Monday, November 9, 2009, at 8:00 p.m. in the Council Chambers of the Municipal Building.

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

In accordance with the New Jersey State Fire & Safety Code I call your attention to the lighted exit signs. In the event the alarm sounds, move in an orderly manner toward the exit nearest you and leave the building.

RESOLUTION EXTENDING CONTRACT OF 
JANEEN McDONALD 
CLERK OF THE WORKS FOR THE 
MUNICIPAL BUILDING RENOVATION PROJECT

WHEREAS, Janeen McDonald was named Clerk of the Works for the Municipal Building renovation project on June 11, 2008; and

WHEREAS, the original contract stipulated a 15 month agreement, from July 2008 through September 2009, for compensation in the amount of $67,500, or $4,500 per month; and

WHEREAS, project has taken additional time for completion, therefore requiring an extension of the contract for the Clerk of the Works for an additional 3 months extending for October, November and December 2009, at $4,500 per month or $13,500.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Glen Rock that the contract for the clerk of the works for the Municipal Building Renovation Project be extended to include October, November and December 2009, at a monthly rate of $4,500, for a total of $13,500.

4. Resolution Establishing a New Petty Cash Fund (Library)

Resolution Establishing a New Petty Cash Fund

Whereas, NJS 40A:5-21 authorizes the establishment of a Petty Cash Fund in any county or municipality by application and resolution, and, 

WHEREAS, the Borough of Glen Rock, County of Bergen has established such a fund for the Free Public library in the amount of $100.00,

WHEREAS, the custodian for this fund, Cathy Vedder, is retiring from the Borough of Glen Rock effective December 1, 2009, and,

WHEREAS, the new custodian for this fund, Mary Kruyff, who is bonded for the amount of $1,000.00; such custodian shall maintain records for this fund in a manner conductive to proper accounting and auditing procedures;

NOW, THEREFORE, BE IT RESOLVED, that the Borough Council of the Borough of Glen Rock, County of Bergen hereby authorizes such action and that two copies of this resolution be filed with the Division of Local Government Services, New Jersey Department of Community Affairs for approval.

5. Resolution for Chapter 159 Recycling Tonnage Grant

NJS 40A:4-87

Whereas, NJS 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount was not determined at the time of the adoption of the budget; and

WHEREAS, the Director may also approve the insertion of an item of appropriation for equal amount,

NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Glen Rock in the County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2009 in the amount of $17,448.66, which is now available from the State of New Jersey, State Recycling Fund in the amount of $17,448.66.

BE IT FURTHER RESOLVED that the like sum of $17,448.66 is hereby appropriated under the caption of 2007 Recycling Tonnage Grant; and

BE IT FURTHER RESOLVED that the above is the result of funds from the State of New Jersey, State Recycling Fund in the amount of $17,448.66

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of
Bergen, State of New Jersey, as follows:

Section I - Chapter 216 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Vehicles and Traffic" is hereby amended as to the following sections:

1. Section 216-39 entitled “ Schedule XII: Handicapped Parking” is hereby amended by adding to Section B - On Street Parking, the following: 

Name of Street Side Location
Marinus Place North Beginning at a point 25 feet west of westerly curb line of Doremus Avenue and extending to a point 25 feet therefrom.”


Section II. VALIDITY-SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

Section III All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed. 

Section IV This Ordinance shall take effect upon passage as required by law.

ORDINANCE NO. 1613

AN ORDINANCE TO AMEND CHAPTER 230 OF THE 
REVISED GENERAL ORDINANCES OF THE 
BOROUGH OF GLEN ROCK, 1971 ENTITLED “ZONING” 
BEING AN ORDINANCE ESTABLISHING A UNIFORM
SET OF ZONING REQUIREMENTS; TO MODIFY DEFINITIONS, CONDITIONS AND PARKING REQUIREMENTS

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

Section I - Chapter 230 of the Revised General Ordinances of the Borough of Glen Rock 1971, as amended, being an Ordinance entitled "Zoning" is hereby amended as to the following section(s):
1. Section 230-4 entitled “Definitions” is hereby amended by deleting “Garage, Private” in its entirety to be replaced with the following:
“Garage, Private. A detached accessory building or portion of a main building intended to be used for the storage of a passenger vehicle or vehicles and not more than one commercial vehicle of a rated capacity not exceeding 1-1/2 tons. Each garage shall not be smaller than 10' wide x 20' deep inside clear dimension and not any larger than 12' wide x 26' deep, not to exceed 36' in width. A carport or any similar structure not completely enclosed shall not be considered to be a garage.”

2. Section 230-4 entitled “Definitions”, is hereby amended by adding thereto the following new definitions:

“Restaurant: An establishment selling food and/or drink mainly consumed on premises with or without wait service.

Delicatessen: An establishment selling prepared food for offsite consumption only. Delicatessen will include take-out only establishments.

School: Any building or part thereof that is designated, constructed or used for education or instruction in any branch of knowledge.

Medical Office: An office for the medical treatment of humans or animals by a licensed or certified medical professional. Medical professionals shall include, but not limited to, physicians, dentists, chiropractors, therapists, veterinarians, etc.”

3. Section 230-14 entitled “Accessory buildings” is hereby amended as to the following subsection:

Subsection 230-14(A)(6) is amended by changing “four motor vehicles” to read “three motor vehicles”.

4. Section 230-18 entitled “Garages in residential districts” is hereby amended by deleting the last sentence in §230-18A which reads: “Garages for not more than a total capacity of four motor vehicles may be erected on a single lot.”

5. Section 230-33 entitled “Offsteet parking in residence districts” is hereby amended by deleting subsection “B” in its entirety to be replaced with the following:

“B. Such driveway shall not exceed 20 feet in width within 16' of the curbline, and may be widened to no more than 25' thereafter. However, if a residence has a 3 car garage, a driveway width of not more than 32' would be permitted from the entrance of the garage to 20' past the garage entrance, then transition to 25' wide (or 20' wide within 16' of the curbline) over the next 5' of length”.

6. Section 230-34 entitled “Offsteet parking in nonresidential districts” is hereby amended as to the following subsections:

A. Subsection A(7) entitled “Eating and drinking places” shall be deleted in its entirety and replaced with the following:

“A(7) Restaurants.

( a ). Restaurants with wait service: one for each 100 sq. feet of gross floor area.

( b ). Restaurants without wait service: one for each 150 square feet of gross floor area”.

B. Subsection A(15) entitled “Medical or dental offices” shall be deleted in its entirety and replaced with the following:

“A(15) Medical offices: one space per 100 square feet of gross floor area”.

C. Subsection A(25) entitled “Retail stores or service establishments and take-out food establishments for consumption off-site” shall be deleted in its entirety and replaced with the following:

“A(25)” Retail Stores and Delicatessens: one space per 200 square feet of gross floor area.”

D. Subsection A(26) entitled “Salons/barber shop/massage therapy/tanning salon and the like (personal care)” shall be deleted in its entirety and replaced with the following:

“A(26) - Salons/barber shop/massage therapy/tanning salon and similar personal care establishment: one space for every 75 square feet.

E. Subsection A(27) entitled “Schools” shall be amended by deleting paragraph (d) in its entirety and replaced with the following:

“A(27)(d) - An establishment having classes for academic, physical or social enrichment, either for adults or children, such as cooking, martial arts, fine arts, test preparation, etc., one space per 75 square feet of gross floor area.”


Section III. VALIDITY-SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

AN ORDINANCE TO AMEND CHAPTER 192 OF THE 
REVISED GENERAL ORDINANCES OF THE BOROUGH
OF GLEN ROCK - 1971 AS AMENDED ENTITLED 
"SUBDIVISION OF LAND”; TO PROVIDE FOR MINOR SITE PLANS


BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

Section I. Chapter 192 of the Revised General Ordinances of the Borough of Glen Rock, 1971, as amended, being an Ordinance entitled “Subdivision of Land” is hereby amended as to the following subsections: 

1. Section 192-5 entitled “Definitions” is hereby amended by adding thereto the following:
“Minor Site Plan: A development plan of a lot where only changes to the parking area are proposed including striping, dumpster location, fencing, location of handicapped parking, curbing, etc. Also changes to use which intensifies the parking requirement. Classification as a minor site plan is at the discretion of the Zoning Official.
Major Site Plan: Any site plan not classified as a minor site plan.”


2. Section 192-9 entitled “Minor Subdivision Procedures and Plat Details” is amended by changing the title to read “Minor subdivision and minor site plan procedures and plat details”. 

Section II. 5. MEETING OPEN TO THE PUBLIC: (Before speaking at the meeting, each person must state their name and address. 5 minute limit)

Mary Henninger – Thornbury Avenue – Mrs. Henninger questioned the solid waste collection bid notice.

Mr. Allen – 16 Benson Road – Mr. Allen questioned the leaf clean-up schedule. Council member Surrago stated leaf pick-up is scheduled for November 1st through December 15th. The problem lies with all of the leaves coming down at once so the initial pick-up is taking longer.
